Welcome to Characey. These Terms & Conditions explain how our online store works, including ordering, payment, personalised products, delivery, returns and your rights as a customer.

Characey operates as an online business and does not operate a walk-in retail store from the above address.
Characey offers a range of products including Custom Apparel, School Merchandise, Branding & Printing, Personalised Gifts and other customised products displayed on the website from time to time.
We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and specifications displayed on the website are accurate. However, colours may appear slightly different depending on the customer’s screen, device or display settings.
Product availability may change from time to time. If a product becomes unavailable after an order has been placed, Characey will contact the customer and provide an appropriate solution in accordance with applicable law.
Many Characey products are made or customised according to the customer’s specifications.
Customers are responsible for checking all information supplied to Characey before production, including names, spelling, dates, sizes, colours, quantities, logos, artwork, photographs and other personalised details.
Once production of a personalised or customised product has commenced, changes or cancellations may not be possible.
Where Characey identifies an obvious error in customer-supplied information before production, we may contact the customer for clarification.
Characey is not responsible for errors in a personalised product where the error resulted from incorrect information, spelling, artwork or instructions supplied or approved by the customer.
Personalised products are made specifically for the customer. Accordingly, the statutory cooling-off provisions applicable to qualifying electronic transactions may not apply to goods made to the customer’s specifications or clearly personalised. This does not affect any other rights the customer may have under applicable consumer-protection legislation.
Where customers provide logos, photographs, artwork, trademarks, names or other material for use on a product, the customer confirms that they have the necessary rights or permission to use that material.
The customer is responsible for ensuring that any material supplied to Characey does not infringe the copyright, trademark, intellectual property, privacy or other rights of another person or organisation.
Characey reserves the right to refuse to reproduce material where we reasonably believe that doing so may infringe another person’s rights or may be unlawful.
Characey retains ownership of its own logos, branding, website content, product designs, original artwork, photographs, graphics and written content. These materials may not be copied, reproduced, distributed or commercially used without Characey’s prior written permission.
Orders may be placed through the Characey online store.
When you place an order, you are making an offer to purchase the selected products. An automated order confirmation may be sent to the email address supplied during checkout. This confirmation acknowledges that the order has been received and does not necessarily constitute acceptance of the order.
Characey reserves the right to decline or cancel an order where:
• a product is unavailable;
• there is an obvious pricing or product-description error;
• the information supplied is insufficient to fulfil the order;
• payment has not been successfully received;
• the requested customisation cannot reasonably be produced; or
• there is another legitimate reason preventing fulfilment of the order.
If Characey cancels an order after payment has been received, any refund due will be processed in accordance with applicable law.
All prices displayed on the Characey website are in South African Rand (ZAR).
The price applicable to an order is the price displayed at the time the order is placed, subject to obvious errors.
Where applicable, delivery charges and other additional charges will be displayed before the customer completes the purchase.
Characey currently accepts payment by credit or debit card, EFT and PayFast.
Orders requiring payment will only proceed to production once the required payment has been successfully received or confirmed.
Customers must ensure that the payment information supplied during checkout is accurate and that they are authorised to use the selected payment method.
Characey uses third-party payment service providers to process online payments and does not store customers’ complete card details.
Characey reserves the right to change product prices at any time. Price changes will not affect an order that has already been accepted and paid for, subject to applicable law.
Standard products generally require 5–10 working days for processing and production.
Personalised products generally require 10–15 working days for processing and production.
Production time begins once payment has been successfully received and, where applicable, all required personalisation details, artwork or approvals have been received.
Courier delivery time is additional to the production timeframe and depends on the delivery destination and courier service.
Production and delivery times may vary depending on the nature and complexity of the order, quantities ordered, availability of materials, customer approval requirements, supplier delays and circumstances outside Characey’s reasonable control.
Characey will make reasonable efforts to fulfil orders within the applicable timeframe and will communicate significant delays to affected customers where reasonably possible.
Customers are responsible for providing a complete and accurate delivery address and contact details when placing an order.
Characey cannot be held responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete delivery information supplied by the customer, failure to respond to courier communication, or failure to accept delivery.
Where a parcel is returned to Characey because of an incorrect address or failed delivery, additional delivery charges may apply before the parcel can be resent.
Customers should contact Characey as soon as possible if they notice that their delivery information is incorrect after placing an order.
Characey respects all applicable consumer rights under South African law.
Where applicable, the Electronic Communications and Transactions Act 25 of 2002 (ECTA) provides consumers with a seven-day cooling-off right for qualifying electronic transactions, subject to the exclusions contained in the Act.
This cooling-off provision does not apply to goods made to the consumer’s specifications or clearly personalised, where the relevant statutory requirements are met.
Accordingly, a customer may not rely on the ECTA seven-day cooling-off provision simply because they have changed their mind about a personalised or custom-made product.
This does not affect any other rights the customer may have under the Consumer Protection Act 68 of 2008 (CPA) or any other applicable law.
Where a return or refund is permitted by law or these Terms & Conditions, Characey will process the applicable remedy in accordance with the relevant statutory requirements.
If a product is defective, damaged, unsafe, does not correspond with the order, or otherwise fails to comply with applicable consumer-protection requirements, the customer should contact Characey as soon as reasonably possible.
The Consumer Protection Act provides statutory protections relating to defective goods. Where applicable, these may include the right to return qualifying defective goods and receive the remedy provided for by law.
Customers should contact hello@characey.co.za and provide their order number, a description of the problem and photographs where appropriate.
Characey may reasonably request that the product be returned or made available for inspection where necessary to assess the complaint.
Nothing in these Terms & Conditions limits any statutory consumer rights that cannot lawfully be excluded or limited.
Personalised products are not excluded from statutory consumer protection simply because they are personalised.
Where a personalised product is defective, incorrectly produced by Characey, materially different from the agreed specifications, or otherwise fails to meet applicable statutory requirements, the customer’s rights under the Consumer Protection Act remain applicable.
However, Characey is not responsible for an error caused by incorrect information, spelling, artwork, sizing or other details supplied or approved by the customer.
Customers should contact Characey as soon as possible if they wish to cancel an order.
If production has not commenced, Characey will consider the cancellation and any refund due in accordance with applicable law.
Because personalised products are made specifically for the customer, cancellation may not be possible once production has commenced, subject always to the customer’s statutory rights.
Nothing in this section limits any cancellation or refund right provided by applicable law.
Characey makes reasonable efforts to ensure that information published on the website is accurate and current.
However, errors or omissions may occasionally occur. Characey reserves the right to correct errors, update information and make changes to products, pricing, availability and website content without prior notice.
Characey aims to keep the website available and functioning properly but cannot guarantee that the website will always be uninterrupted, error-free or available.
Website availability may occasionally be affected by maintenance, technical problems, hosting issues, internet service interruptions, security incidents or circumstances outside Characey’s reasonable control.
Customers may use the website only for lawful purposes and must not knowingly misuse the website, attempt to gain unauthorised access to any part of the website, introduce malicious software or interfere with its normal operation.
Characey collects and processes personal information that is necessary to operate the website, communicate with customers and fulfil orders.
This may include information such as your name, email address, telephone number, billing address, delivery address, order information and information provided when contacting Characey.
Personal information will be processed in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).
Characey takes reasonable steps to protect personal information against loss, misuse, unauthorised access, disclosure or alteration.
Please refer to Characey’s Privacy Policy for further information about how personal information is collected, used, stored and protected.
Characey uses third-party payment service providers to process online payments.
Customers should review the applicable payment provider’s terms and privacy information where appropriate.
Characey does not store customers’ complete card details. Payment information is processed through the relevant secure payment service provider.
Characey takes reasonable steps to protect customer and payment information and uses appropriate security measures for online transactions.
Customers are responsible for ensuring that they are authorised to use the payment method selected when placing an order.
Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot legally be excluded or limited under South African law.
Subject to applicable law, Characey will not be responsible for delays, loss or damage caused by circumstances outside its reasonable control, including courier disruptions, internet or telecommunications failures, payment-provider interruptions, supplier shortages, power failures, severe weather, natural disasters, strikes, government restrictions, civil unrest or other events beyond Characey’s reasonable control.
Where such circumstances affect an order, Characey will make reasonable efforts to communicate significant delays to the affected customer and work towards resolving the matter as soon as reasonably possible.
We want every Characey customer to have a positive experience.

Characey will consider complaints fairly and in accordance with applicable consumer-protection legislation.
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute arising from the use of the Characey website or the purchase of products from Characey will be dealt with in accordance with applicable South African law and the customer’s statutory rights.
Nothing in these Terms & Conditions prevents a consumer from exercising a right available under applicable consumer-protection legislation.
Characey may update these Terms & Conditions from time to time to reflect changes to the website, products and services, business practices, applicable legislation or other relevant circumstances.
The latest version of these Terms & Conditions will be published on this website.
The Terms & Conditions applicable to an order will generally be those in force at the time the order is placed, subject to any mandatory legal provisions that apply.
